Quintilian is an important figure of the history of education, his lifetime career and thought making the Flavian dynasty of the Roman Empire as a critical period. Understanding Quintilian’s lawyer education should be aware of the historical context when Rome era into the Mediterranean. Octavian reconstructed the Roman Empire constitutionalism, especially Roman Senate and the province system, shifting the focus from military exploit toward law rule, which is the basic background of the Roman legal education. Roman law provides for unique aspects of the Romans, which is important ways and means for understanding Roman society.Quintilian’s lawyer education bases on his person’s theory and rhetoric. The Doctrine of people mainly includes three aspects of language, education and politics. Quintilian’s thought about the language is a pragmatic grasp of the language, focusing on the use of language, is especially concerned about the social forces of the language. About education, Quintilian discusses people’s education is entirely possible and feasible, and emphasizes the significant role of education and the necessary. In terms of political, Quintilian held a positive view of citizens, emphasizing the participation and contribution of the citizens of the Roman Empire, which also showed Quintilian endorsement and support of the constitutional system of the imperial regime.Quintilian’s rhetoric is the basic doctrine for his lawyer’s education. Quintilian’s rhetoric, with rich content and extensive range, is about good man speaking well. While adhering to the tradition of the persuasive, it contains identity keynote and strives for the unity of goodness and truth-seeking. Quintilian rhetoric essence is an important clues and foundation to understand legal education thinking.The realization of Quintilian’s great goal depends on effect teaching practice. Rhetoric is the fundamental teaching concept in legal education pedagogy, speaking well in legal also becoming as a kind of rhetoric. General speaking, just like normal pedagogy, legal education pedagogy considers teaching and learning as a bilateral activity:students are the audience exists and teachers are merciful father. Quintilian’s legal education pedagogy has its special features: case method, simulation of Pedagogy and clinics pedagogy are the typical specific pedagogy which is more or less different from the current situation and however particularly relevant to the professional practice. Quintilian’s lawyer education is still theoretical value and significance for us so far.
