With the continuous advance of China’s reform of the personnelsystem, the personnel structure of the institutions become increasinglycomplex, application of law on the employment relationship of theinstitutions has been at the edge of the legislation and the gray area.Introduced in2008,"Labor Contract Law"96appears to the scope of theemployment relationship of the institutions included in the adjustment ofthe labor law system, but this provision does not directly on the specialproblems of the employment contract making the required, but by otherlegal the regulations make provision for the special problems of theemployment contract. Can only be said to be "temporary solution". Firstly,China’s institutions and institutions hiring system are briefly set forth, andsecondly, on the basis of interpretation of section96of the LaborContract Law, research institutions in China employment relationshipexisting laws applicable to problems and face the plight of the thirdanalysis of the lack of legislative and operational work in practice, the employment contract management exposure. Finally, some feasiblesuggestions on how to improve the employment relations system andinstitutions.the establishment of a comprehensive employment contractlaws and regulations of the institutions is important to improve the legalconstruction of China’s institutions.
