| Illegal business crime was the addition charge of the criminal law in1997,on thebasis of abolishing the decomposed speculation and profiteering crime, its aim is toattack the illegal operation which seriously disrupted the marked economic order ofsociety. But the content of behavior of illegal management crime is continuouslyexpanding, there exist many conflicts in theory whether some behaviors are complyingwith the illegal business crime. At the same time, the behavior and extend of illegalbusiness crime is more and more extensive in the process of judicial conviction. Tosome extent that violates the principle of a prescribed punishment for specified crimeand citizens’ legal rights can’t be protected. The author mentions her own viewpoint onthe basis of analyzing judicial cases in recent years and summarizing theoreticalresearch, this article explained the range of illegal operation, the definition of violatingthe Chinese law，fallback of provision, and analysis the behavior of cases in detail. |
