Companion animals have become an integral part of the emotional life of many people. At present, there is no one complete national law of companion animal protection in our country, so that the living condition of companion animals in our country can not get effective guarantee. In recent years, a variety of cruelty events on companion animals occur frequently, including abuse, abandonment, killing, and so on. Such behavior not only threatening the survival of companion animals, but also affect the mental health of our citizens, serious damage to the international image of China. Therefore, in order to achieve a harmonious coexistence between man and animals, improve the survival status of companion animals, maintain good social order, prevent and reduce the occurrence of crime, protect human public safety and public health and environment, promote the construction of spiritual civilization in our country, inherit and carry forward our country the excellent cultural tradition to take care of the life, respect life, improve China’s international image and enhance its international status, promote the economic development of pet industry in our country, the establishment of the companion animal legal protection mechanism is imperative.The legal status of companion animals should be distinguished from other inanimate objects, it should receive special protection as a special kind of guest, at least, it should be given its most basic survival benefits. China already has the basic foundation to give the protection of basic welfare of companion animals, including the material basis, cultural foundation, people and organizational basis, and legal basis. Based on this, the author put forward the idea on the five areas about the establishing of the legal protection mechanisms of companion animals. Including to establish a scientific concept and a clear legislative intent, follow the proper legislative principles, establish and improve the basic system, improve the regulatory mechanism, and clear the liability of violations.
