Legal Thinking Abnormal Phenomenon Of The Petition

In recent years, an unusual complaint reporting situation becomes more and more serious, which presents for large scale, frequency, diversification of participation number and so on. Such phenomenon brings many negative impacts to our society. Therefore, it has become the prominent problem affecting social stability, which seriously interferes with the advancement of "Strategy of ruling the country by law" and hinders the "administration according to law". It becomes the prominent problem that affects social stability. At present, how to take some affective measures to eliminate such phenomenon is the biggest concern to the field of petition. This article analyzes the present situation of the abnormal phenomenon of letters and visits from three aspects, which includes the concept, forms and the negative consequences. Moreover, the author digs into the causes of such phenomenon and finds out the two main reasons, which concerns on two aspects. One is that petition system itself exists certain problems. The other one is that other relief channel is not smooth enough. So basing on the position of the letters and calls system, the adjustment of accepting scope, the institutional setting, the rules of the petitioning process, the improvement of check mechanism and the accountability implement, we try to discuss and seek affective ways to break out the legal paths of solving this problem. Therefore, we must establish scientific systems, enact the corresponding laws, improve the working mechanism of resolving the problem, perfect the working mechanism, expand legal channels to solve such contradiction. Moreover, we should promote the resolving ways to the problems of non-normal petition, maintain the normal petitioning order to promote the virtuous development of the complaint reporting handling office and ensure the social harmony and stability.
