| In the21st century, with the development of productive forces, the demand for energy is increasing, especially in oil resources as the representative of traditional energy resources in onshore oil resources are increasingly unable to meet people’s needs, people began to look turned to the ocean. With offshore oil exploration, transportation continues to develop, marine oil pollution damage caused by gradually serious, including damage to the marine living resources, hazards to human health, hindrance to fishing and other legitimate activities, damage to the water quality and the use of environmental quality impairment. Marine oil pollution damage mainly from offshore oil rigs and similar construction projects oil spill, oil spills and ship collisions land oil pollution leaks in three aspects.The marine environment is complex and diverse, after the incident will result in a wide variety of oil pollution damage, first is the destruction of the marine environment as well as clean-up and this take enormous human and material resources, followed by the coastal oil spill may also cause coastal harbor, waterway closed to other industries such as aquaculture, tourism has brought a heavy blow. Where fishermen farming, harvest losses, coastal seafood restaurants, hotels, beach and so will have a huge pure economic loss. In recent years, Chinese marine oil pollution incidents occur frequently, with the accelerated process of Chinese rule of law, awareness of legal rights significantly improved, pure economic loss suffered people began to pick up the legal weapons to protect their interests. Therefore, the importance of marine oil pollution damage in the study of pure economic loss has become increasingly prominent.This article applies the method of comparison analysis. In the base of three different legislative models and International Organizations’ treatment, and analyses the current status of legislation and judicial practice of pure economic loss relating to marine oil pollution damage in our country, finally hope this article can be able to make useful recommendations on handling the issue. This article can be divided into four segment: The first part is a marine oil pollution damages for pure economic loss in an overview of the concept of pure economic loss; second part is the theory of several marine oil pollution compensation for damages for pure economic loss a brief analysis; the third part is a marine oil pollution damage in the comparative study of pure economic loss, through a comparative study of three legislative model analysis of the problem and treat the international practice, hoping to find a more suitable mode of China; the fourth part is China’s marine oil pollution damages the status of legislation and practice and perfect the system of pure economic loss is recommended. |
