Article46of our Constitution stipulates: People’s Republic of China citizen has theright and obligation to receive education. The state promotes the all-round development ofchildren and young people, morally, intellectually and physically. The fundamental rightincludes equal access to receive education, to receive a complete education process, toreceive a comprehensive education, to receive continuing education rights. Therefore, as afundamental right of citizens, the right to receive education is the Constitutionalembodiment of the values of substantive equality. While as a special group in thesociety, the athletes spend most of their time upon training and competition, their rightswere damaged in various ways since the very beginning of their careers such as the lack ofpre-school education, the lop-sidedness of compulsory education, the dilemma ofsecond-level education and the unfairness of higher education. Considering thedisadvantages of that, this paper is aimed to analyze the root causes of the deficiency ofguarantee against damages to their rights to receive education respectively from theobjective and subjective aspects. Therefore, by enacting comprehensive laws, enhancingtheir legal awareness, perfecting the teaching methods, ensuring the educationalinvestments, strengthening the supervising of all departments and improving the ways oflegal relief and etc., we can guarantee the rights of athletes to receive education to be fullyrealized. |
