Flexible Employment Injury Security Law Issues

The flexible employment as a booming employment form has developed fully and fast after the reform and opening-up policy and it also gives remarkable contributions to the development of our economy. However, it is very often for the flexible employees to suffer the work-related injuries and occupational diseases in the real life. And because of the lack of effective work-related injury protection system, the legal rights and interests of a large number of flexible employees have been brutally and cruelly ruined. So this article put forward the thoughts of establishing the work-related injury insurance of the flexible employee through the discussion about the related issues of flexible employment and combining with the domestic and foreign work-related injury protection system in order to protect the interests of the flexible employees better.This article mainly includes four parts. The first part is the introduction which mainly introduces some basic problems involved with the protection of work-related injury of the flexible employee that embrace the research background and significance, the related researching documents and conceptions so as to build theoretical foundation for the further study. The second part mainly discusses and analyzes our conditions of the flexible employees and mentions the practical and theoretical difficulties for the protection of the work-related injury of the flexible employees in order to offer an emphasis for the following passage. The third part mainly reviews and absorbs the advanced theories and mature experiences of developed countries in the protection of work-related injury insurance of the flexible employees from the view of comparable research. The fourth part comes up with the recommendation that the work-related injury insurance for the flexible employees should be built up based on the theory that the establishment of work-related injury insurance system for the flexible employees from the law level is extraordinarily necessary and combined with massive domestic and foreign scholars and practical experience and models.
