China’s foreign aid has developed for over60years, which has made gratifying achievements and received worldwide accolades. But the progress of its legal system development is facing many difficulties. The regulations of China’s foreign aid is still stuck in the category of the departmental regulations, which is short of the higher-level law guidance.The status quo about China’s foreign aid’s legal management has become an important reason that restrict its deeper development.The purpose of the author write this article is exploring the management of China’s foreign aid by law, searching in the problems and drawbacks of today’s legal institution of China’s foreign aid, making some suggestions about legislative framework for China’s foreign aid in future.This article includes three parts. The first part introduces the history and current situation of china’s foreign aid, also its management and the mode of implementation.
