It has been 17 years since China opened the medical service to foreign capitals since 1989.And within the past 17 years,China experienced two blooming period,one is China joined the WTO,another is Chinese reform of State-Owned hospital.However,the development of foreign owned medical institution are still facing the various limitation in China,compared with other service sector,the utilization of foreign capital of medical service in china is very low.According to 2016 The Statistic on FDI in China,which was published by MOFCOM recently,the amount of foreign capital actually utilized is round USD 0.143 billion,only 0.11% of the total FDI.This thesis tried to analysis the reasons for foregoing status by going through the laws and regulation in chronological sequence,as well as the operation status of foreign-owned medical institutions via various public resources and data.On top of that,the writer further researched and made analysis on main problems of medical institution at this stage as well as the nature of medical service as public welfare,and the approach of other WTO members.Based on that,the writer raised suggestion including(1)persistence of market opening,and encourage foreign capitals to invest into Chinese medical service by utilizing the advance of FTZ,as well as the changing of roles of government from service provider to market monitor;(2)set threshold of different type of medical institution,mitigate the gaps of capitals from Hongkong,Macao,Taiwan and other countries and areas;(3)enhance the transparency government information publicity;(4)enhance the supervision of healthcare center especially the treatment of patient,and patients’ data security.
