| As a special kind of commodity, housing market doesn’t works well on its own. Rely onself-regulation of market does not balance between supply and demand. In recent years, thereal estate market grows faster, greatly promoted the economic development, but the demandof low-income housing is increasing. This trend has affected social harmony and stability,lead to social and political problems. In1994, Chinese government began to build affordablehousing system, and it has gradually become one of the main measures to solve the difficultproblem of housing for low-income families. As an important part of the housing securitysystem, affordable housing system is the use of market mechanisms and government whilemacro-control means, safeguard measures to solve the difficult problem of the low-incomehousing, both the regulation of the housing market and adjusting income distribution function.However, due to the lack of relevant legislation and supporting the regime, the regimes thereare many problems in practice. Therefore, this article is intended to analyze the problem ofaffordable housing through a system generated during operation and their causes, and on thebasis of public housing system and the extraterritorial similar comparative study on affordablehousing issues related to systems analysis and elaboration, and the corresponding legalcountermeasures. This paper is divided into there parts:Firstly it clarifies the definition, characteristics of the affordable housing as well as itsroles in house ensuring through comparison of the commodity housing and low-rent housing.Then it analyses the status and functions of the legal system in the affordable housing policy.The affordable housing system played stabilize prices and guarantee a positive role inlow-income populations since its implementing. However, because the relating legislation andsupporting system is not perfect, the current law system still has a lot of problems in theory aswell as in practice. Long-term mechanism hasn’t been formed, lack of access maneuverability,lack of dynamic construction of affordable housing regulation, price management andproperty management imperfect. From that we can see it is of great necessity to enhance ouraffordable housing legal system. In this part,the author gives a series of advices to sole those problems that mentionsbefore. combined with China’s national conditions, drawing on the merits of extraterritorialsimilarity housing system, suggestions to improve our affordable housing system:development of "affordable housing management implementing regulations" to enhance thelegislative level system; improve the exit mechanism, establish affordable housing tradedprohibit the establishment of the government led to repurchase the system affordable housingaffordable room circulation system. |
