Energy Saving Voluntary Agreement Research

With the increasingly serious environmental problems and energy crisis, the existing environment of the administrative and legal regulations can not be an effective solution to the energy and environmental disputes. Voluntary Agreement as a new energy-saving mechanism, a very wide range of applications in the international non-mandatory energy efficiency measures. Shandong Iron and Steel Industry in2003carried out the first pilot of the Voluntary Agreement and achieved remarkable results.The author of the theory and practice of energy conservation voluntary agreements related legal issues to be explored that institutional promotion of obstacles, and finally a system suited to China’s specific national conditions, system design, and the summary of the pilot work in Shandong.The paper is divided into five parts:The first part introduces the concept of energy conservation voluntary agreement, and an analysis of its legal nature. The second part of the theoretical basis of the Voluntary Agreement. Environmental economic instruments has a strong role of the government through economic leverage should fully mobilize the enthusiasm of enterprises, enterprises must bear some social responsibility in the pursuit of economic interests. The third part, set forth the basic principles of the Voluntary Agreement, to ensure the system is designed to not deviate from the implementation process. The fourth part, combing energy conservation voluntary agreement pilot in Shandong Province, to analyze the achievemente and the problems. The fifth part, put forward the proposal to build a voluntary energy conservation agreement in line with China’s national conditions, and provide system relying on for the better to carry out energy-saving work.
