On The Legal Protection Of Villagers’ Autonomy

The emergence and development of villagers’ autonomy have been greatly promoting the process of democratization in China. However, with the development of society and the deepening of economic reform, some practical and theoretical troubles emerged out in the practicing process of villagers’ autonomy, and especially those troubles which are concerned with law always made us helpless.Therefore, I try to search the influence of villagers’ autonomy on the construction of China’s basic level democracy from the perspective of Constitutional Law in this article:trough analyzing the defects concerned with Laws and regulations of current villagers’ autonomy, dissertating the necessity of the law protection of villagers’autonomy by using Law Analysis, to further build the perfect legal security system of villagers’ autonomy and guarantee villagers’ autonomy running well on the legal track, truly realizing democratic elections, democratic decision-making, democratic management and democratic supervision in villagers’ autonomy, accelerating the process of democratization, and achieving democratization management of our country and society.The Paper is divided into four parts:the first chapter analyzing the meaning of villagers’ autonomy from the start of its legalization process history, and analyzing the influence of villagers’ autonomy on the basic level democracy in our country form the perspective of Constitutional Law; the second chapter briefly dissertating the meaning, the content and the necessity of legal protection of villagers’ autonomy; the third chapter analyzing the current situation and problems in legal protection of villagers’ autonomy; the last chapter systematically elaborating the legal protection of villagers’ autonomy, mainly analyzing the four aspects--democratic elections, democratic decision-making, democratic management and democratic supervision, and analyzing the problems in the practical process of villagers’ autonomy, and analyzing the key problems in the practical process of villagers’ autonomy, such as bribery in an election, villagers relationship, publicity of village affairs from a legal point of view and putting forward my own opinion.
