Research On Legal Problems Of Food Safety Regulation

Food safety problem is not only economic and management problems, but also a legal problem. Since June2009the introduction of "food safety law", the food safety events in our country still emerge in an endless stream reflecting that the government could not use legal means to implement effective supervision on food. Therefore, how to effectively improve the food safety supervision in China has become a very important research topic.Based on the supervision of food safety as the main research object, the paper tries to improve the food safety supervision system in China, legally thinking about and analyzing China’s food safety regulatory issues. The paper,in addition to the introduction and conclusion, is divided into three parts:the first part is to introduce the basic theory of food safety regulation and the main problems and make clear the basic concept of food safety and food safety legal supervision firstly; and then describe the law system of food safety law and supervision system in China; finally, the main problems of food safety supervision in China, such as serious flaws in the supervision system, lacking of laws and regulations supporting supervision and management, the lagging behind and not unified food quality standard, the not perfect detection system and the falling behind detection technique etc.. The second part is to introduce the food safety supervision system in developed countries. For example, in the United States, Canada, the European Union and Japan, three aspects are compared, including food safety laws and regulations in developed countries, the developed countries the system of food safety supervision and management system and the advanced regulatory measures in the developed countries; through the introduction of the practice of developed countries and summing up the food safety the legal supervision in the developed countries, we draw the inspiration from three aspects, a unified independent regulatory body and coordination mechanism, the perfect laws and regulations and paying attention to risk control and hoping to make a reference for our current regulatory status. The third part is about strengthening the construction of food safety supervision system of our proposal and discussing dividedly the perfection of the legal system of food safety supervision in China, the improvement of China’s food safety supervision structure, the detection technology and food safety detection system in details; firstly the legal system is as the start, such as speeding up the construction of the legal system of food safety standard and food safety standard system; and then the food safety regulatory functions should be highly concentrated, and then we should reorient the Food Safety Commission, establishing a set of food safety supervision mechanism and constantly improving the food safety prevention mechanism; Finally, we should strengthen the technical support, set up scientific detection mechanism and increase food inspection institution capacity building.
