As a commercial mark, trademarks play an important role in society. Withlong-term use, the well-known trademarks, bearing a good reputation, has become amajor asset of the enterprise. Well-known trademark protection system provides aspecial way to protect the trademark rights. Swarovski trademark case mainly relates tothe protection of well-known trademark. The case is typical and meaningful. The mainfocus in the case is whether the trademark is well-known, as well as the criteria ofviolations of well-known trademarks. This case reveals the conservation status of thewell-known trademarks in China. By analyzing Swarovski trademark case, this articleintroduces and analysis China’s well-known trademark recognition and protectionsystem, pointing out its problems and shortcomings, then putting forward some legalsuggestions.This article consists of four chapters. Swarovski cases and court decisions areintroduced in the introduction. Chapter I introduces the identification system ofwell-known trademarks in China, from the point of view of the methods, the standardsand the principle to apply. The second chapter first introduces the basic theory ofwell-known trademarks, and then specifically discusses the special ways of theprotection of well-known trademarks internationally and domestically. Chapter IIIintroduces the protection of well-known trademarks in china. In the last part, somesuggestions on improving the well-known trademarks law are proposed.
