Studies Of Environmental Information Disclosure System

The rapid development of economy and society will inevitably lead to a series of environmental problems.With the frequent environmental pollution accidents, the public’s environmental awareness begins to awake and more and more people ask to participate in environmental management activities.Therefore, public participation established as one of basic principles of Chinese environmental and resources protection law has become an important way in national environmental management and an important motivation of environmental democracy-building in China.Promoting environmental democracy is to make the public involved in the environmental management activities.But the premise is that national environmental resources management and environmental policy will be informed.So government departments need to provide a platform and disclose the related information.For that purpose, Disclosure of environmental information system and protection of the public right to know the environment has become the key issue.Comparing with some western countries, China has established the System of environmental information disclosure but still has many problems.In2007the State Council and the former State Environmental Protection Administration has formulated China’s " Disclosure of Government Information Regulations" and "Disclosure of Environmental Information (Trial)" and implemented on May1,2008. The two regulations mentioned above have significance but implemented illy because of weak and inadequate power.Therefore, taking the environmental right to know as a starting point and comparing with the related system of western countries, this article concludes that China should focuse on legislative system, the establishment of the environmental right to know and the contents of the existing rules and regulations. Established in the Environmental Protection Act, Environmental right to know could provide a sufficient legal basis for disclosure of environmental information system and also advance the process of building of Chinese environmental democracy.
