Application For Issuance Of Shanxi A Company And Its Bill Dispute Case Analysis

With the development of the market economy, bill as one of the carriers of commercial activity is playing an increasingly important role and is recognized increasingly and used widely by people. However, the loss of bill occurs from time to time in the process of bill holding and bill circulation for the bill is the circulative security. Although it is the abnormal situation in the bill circulation, it will lead to the interruption of bill’s right execution which may cause the barriers to the realization of bill stakeholder’s interest and the smooth progress of economic activity. This paper has analyzed and discussed the inefficiency of current Chinese laws in the aspects of the public notification system through the case of public notice application and related bills of one company in Shanxi Province. It aims to perfect the public notice system and protect the bill right of stakeholder, to maintain the safety of market transactions and promote the economic prosperity and stable development.This paper includes three parts. The first part introduces the basic details of case, the first part of the selection with "application for issuance of Shanxi a company and the related bill dispute case" as the breakthrough point, the focus of case dispute and relevant legal issues. Through introducing the case, it has discussed the relevant legal issues in the judicial practice. The second part illustrates the existing problems of current public notice system in China and mainly analyzes the procedure and period problems of public notice cases., for this case involved a few disputes through legal analysis. The third part puts forward the establishment of a perfect remedy for loss of bill., put forward my own opinion and the suggestion, mainly includes the perfect the procedure of public notice and period, and establish to revoke a judgment of abridgement of rights lawsuit, to set up the lost ticket relief suit, etc.
