Empirical Research On Changsha A Residential Community Owners’ Autonomy

Residential owners’autonomy is a basic autonomous mode refers to the city residential area based on the distinction between ownership of all owners of construction, in accordance with the laws and regulations, to establish an autonomous organization, establish norms of autonomy, decide and manage residential district within the scope of public property matters through the democratic process. Owners’ autonomy is the important concept and mode of the city management with modern,scientific,legal development of the management of city, it is also the inevitable outcome of social political and economic progress and development of the modern city construction management of our country. However, as the majority of owners lack of awareness of participation and autonomy concept, the laws and regulations of owners’autonomy are too principled, owner committee in the actual operation of the process is lack of effective supervision and other reasons.The development of owners’autonomy system in China is difficult. Exploration of A residential community owners’autonomy process is long and hard. Because the owners are not familiar with each other, the master’s and autonomy consciousness of the owner is not strong, so causing the first owners of the committee of A residential community arises deformityly.Because its behavior is not legitimate and violate the legitimate interests of owners, and not respect the views of the majority owners in the management of owners of the committee, causing the dissatisfaction of owners, and eventually burst, causing the events of recalling the new owners of the committee. The owners of A residential community decided to use legal provisions rationally to go legitimate program,to realize the completely autonomous of A residential community through recalling the original owners of the committee, formulating detailed community autonomous’specification, electing the new session of owners of the committee as the foundational democracy system that wining support among the people and improving of owners’autonomy and awareness of rights protection.A residential community is a successful example of the owners of autonomy, completed the non change of owners of the committee through the minority owners’ representative,positive and enthusiastic active and the majority owners’support, sub district office and community leaders’assist and a few professional’s suggestions.The emergence of innovative initiatives in the change process of A residential community, have certain significance to the owners’autonomy of other domestic residential community.
