Study On The Chinese Community Correction

On November12,2013, as the third plenary session of the18concluded,“The centralcommittee of the communist party of China on comprehensively deepening andreformming certain major issues’ decision” clearly puts forward to abolish the reeducationthrough labour, and establish a sound system of community correction. This is not only theprogress of human rights in China, but also meanning more requirements for theinnovation of the punishment execution system in China. Community correction systemhas been known in the international community, and is developing in the westerndeveloped countries. In China, community correction is that the criminal corrected by thespecialized state organs in community within the time limit. Through social groups,non-governmental organizations, social volunteers to assist, correction of criminals tocarry on the education, supervision and management, prompting them to return to societysmoothly. In our country, community correction accepted by people to the advantage ofmanagement education humane and saving execution resources, and was eventuallyincorporated into the criminal law. However, with little experience, the communitycorrection carries out late. How to perfect the community correction system and makingbetter use of its utility has becoming a problem we have to face in the concrete execution.Based on the analysis of the community correction development in China over the pastfew years, this paper mainly studies the implementation of China’s community correction.In the discussion process, by introducing the advanced experience of foreign communitycorrection system, contrasting with some domestic practice, putting forward a series offeasible measures, the writer uses a comparative study of theory with practice, method,combined with the theories of ideological and political education, the practical caseareanalyzed, trying to find some feasible guiding significance to the operation method tomake it more in line with the special situation of our country. In order to contribute to thedevelopment of China’s community correction, the writer gives some suggestions in thecontext of a harmonious society of community correction system.
