The development of modern biotechnology, increase in population, the lack ofland resources, the emergence of genetically modified food more and more in people’sdaily table, have a significant impact on human society. The scientific community hasnot yet on the safety of genetically modified products, technology uncertainty bringsthe dilemma of legal provisions, the world law makers in transgenic legislation of itsown, it is lack of scientific basis. A pressing matter of the moment is to establish andperfect the legal regulation framework of genetically modified food as soon aspossible. Legal framework is the top priority of rules and regulations, both at theinternational level and in domestic law level. Genetically modified food labelingsystem in science is still uncertain, apparent conflicts of interest, people pay more andmore attention under the background is generated, the initiative and the right tochoose all delivered to consumers. The European Union establish its geneticallymodified food compulsory labeling system in nineteen nineties, its legislation is basedon the theory of "the consumer’s right to know principle” and “the precautionaryprinciple". In October18,2003, The European Union promulgated two relevantgenetically modified food labeling regulations, namely "genetically modified foodand feed regulations" and "food and feed products GMO traceability andidentification methods and transgenic biological material traceability regulations".Thus, the genetically modified food labeling law system has become "the moststringent genetically modified food labeling system in the world".This article first chapter first analyzes European Union legal system of GM food.In deconstructing the necessity of the build system to labeling of GM food andconcluded on the basis of system of gm food legislation present situation, to completethe European Union legislation on gm food, dynamic value evaluation, and analyzesthe theoretical cornerstone of the European Union legislation on GM food: consumersinformed choice, the precautionary principle. Second chapter through to the European Union legislation on GM food and specific content of the Cartagena security protocolanalysis, comparing the relation and distinction between, to us at the internationallevel analysis background and development trend of European Union legislation onGM food plays an important role. The European Union Labeling System of GM foodand The Cartagena protocol’s basic legislation spirit is consistent, it is based on TheCartagena protocol, which accords with the situation of the European Union. Thethird chapter analyzes the dispute about European Union legal system of GM food,mainly concentrated in two aspects, one is the conflict with WTO rules. Second is theconflict with the United States which is the representative of voluntary labeling camp.Fourth chapter summary legislation present situation of Labeling System of GM foodin our country, compared to the European Union may find many shortcomings, inreference to the European Union, on the basis of advanced legislative experience, putforward the Suggestions of perfecting our country’s Labeling System of GM food.
