The Study Of Interests Balance Systems Of Copyright Law Under The Digital Background

The development of copyright systems is closely linked with technological progress, from the point of view of that the changes of the core right of copyright (namely the reproduction right) in different technology phases, copyright law is what adjust the change of interests among different groups in order to achieve a balanceing systems. It is an important issue of copyright law to research which about balancing the interests. Since we have been in the digital era, the original balance of interests were broken by the development of science and technology network, then the conflict of interests among the different groups have became increasingly fierce. As a result, interests balance of the copyright law suffer from an unprecedented challenge. This paper starts from the change of reproduction rights with technology development, we propose interests balance and copyright laws bond together, analyzing the interests balance of the copyright law, meanwhile, making the multi-dimensional study, in the term of the system’s philosophical exploration, the pursuit of goals, value judgments, economic analysis, and so on, exploring new problems faced by the copyright law under the digital circumstance, making relevant recommendations about perfecting the system, in order to uphold the copyright owners’benefits, moreover, promoting knowledge and cultural development, achieving the dynamic balance of the copyright law consequently.This paper has five chapters totally:Chapter One, the perspective we brought up is that copyright is a system to harmony benefits among the different groups, it was based on analyzing features of changes of reproduction rights during the technology stages.Chapter Two, making analysis about the balance of interests, and making concepts’definition, relation and theoretical analysis of interests, balance, balance of interests. etc.Chapter Three, making a comprehensive interpretation of the interests balance system from philosophy, goals, values, economic, etc, to explore the benefits balancing mechanism connotation deeply.Chapter Four, digital environment impact on copyrights system and copyrights groups, analyzing the challenges confronted by the system of the traditional balance of copyright law under the digital environment, which includes the rational use of systems, statutory licensing systems, compensation systems.etc.Chapter Five, this part investigates the design of the copyright interests balance systems upon the digital environment, analyzing foothold and responding ideas of the interests balance mechanisms, and we make recommendations on perfecting systems of rational use, compensation, technical measures, copyright information management and so on.
