Research On The Balance Of Interests Between Digital Music Copyright And Digital Rights Management

Copyright is closely related with the development of the technology since it was born.In the middle-late stages of 20 th century,digital technology combined with the Internet due to its low cost,high fidelity and so on advantages,and quickly set off a global "digital storm".This storm not only stimulated the development of the digital music,but also has brought unprecedented challenges to the copyright protection of the copyright owners.Because of wide coverage of the Internet,large number of users and digital technology make the replication and transmission of information become simple and fast,piratical digital music can wantonly dash,the infringement behaviors of digital music also can be found everywhere.Hence,digital rights management plays a role in solving this problem.Around 2014,digital music industry in China began to stride forward pay business model,application of digital rights management in the China’s digital music industry is gradually spreading.However,the highlight shortcomings of digital copyright management on the copyright protection cause popular discontent in recent years.So this paper takes the interests balance principle as theoretical basis,designed to find out the interests maladjustment point of the digital music copyright protection and digital rights management and the causes of problems,for exploring the way to coordinate the rights and interests of digital copyright management and digital music copyright,to promote the development of the digital music industry in China.This paper is divided into four parts except the introduction and the conclusion:The first part defines the related concepts of digital music copyright,the status quo of digital music copyright protection in China;the second part introduces the digital rights management content and comprehensive value,and from the public,copyright holder,industry development,puting forward the problems between interests of the copyright of digital music and digital copyright management;the third part,by the interest the principle of balance and the rational use of system theory,clarifies the relationship of rights and interests from the legal,economic,technology the three angles,analyzes the reason of the conflict of interest.The fourth part puts forward a series of coordination proposals to balance the interests between digital music copyright and digital copyright management.
