The Right Of Personal Information And Protection In Civil Law

In today’s society is called the information society, information for government agencies,enterprises and individuals have become a kind of important social resources. Governmentagencies by collecting different kinds of information as the basis of its decision-making;Enterprises sale of its products through business information; while individuals make personalproperty interest in the use of information. Personal information as a kind of information, itsimportance is growing, the personal information collection, processing and utilizationbehavior is becoming more and more popular. But in recent years, more and more databasedue to hacker attack lead to the fact that the personal information to a large number of leakageof personal information in an increasingly valued at the same time, also faces a growing threat.In our country, to protect personal information under the right of privacy, but the protection ofpersonal information is not enough to protection of personal information to providecomprehensive and effective, thus to establish right of personal information to be independentof specific personality right, and the right of personal information on civil law protection,whether it’s for real, or in terms of theoretical research, has the vital significance.Based on personal information rights of the civil law attribute as a starting point, on thebasis of the study of relevant literature on the concept of personal information rights, elementsand the connotation analysis, concluded that "the right of personal information should be aconcrete personality right ". Secondly, on the right of personal information and privacy, on thebasis of comparison, through the research to the deficiency of the privacy protection ofpersonal information model, reflects the deficiency of the current system of personalinformation protection in China, and demonstrates the necessity of protecting the personalinformation right of independence, and analysis of personal information rights independentlyto protect the feasibility. Finally, by investigating the scope of personal information rightsprotection mode, the model of right of personal information protection in China to providepractical implications, and try to build on system of right of personal information protection.
