Abstract:Intellectual Property (IP) pledge is a kind of important way to IP applieation, on one hand the enterprise can utilize IP financing value by through the IP security interests, on the other hand the funds would be invested to innovation and industrialization that the enterprise can ease fund pressure of developing. Although, IP pledge financing is the marketization of relationship between the enterprise and financial institutions, but because of IP has public policy attribute, the government has the requirements to implement the IP strategy and IP pledge financing has many difficulties, in order to achieve the goal of encouraging social innovation, promoting the use of IP and improving the national core competitiveness, the supporting policy from government in IP pledge financing is necessary. In practice, the local governments in China issued many supporting policies on IP pledge financing, by analyzing these policies we could found they had deficiencies on policy target and policy measures. In addition, by analyzing the patent and trademark’s information of pledge registration, we can foud the characteristics of pledgor and the pledgee in IP pledge financing and the supporting policiy does not adapt the practice of IP pledge financing. Such as the policy’s goal is not clear, the supporting policy’s goal and means are confusing and all types of IP policy does not adapt to the characteristics of patent, trademark. The paper argues that we should positioning the supporting policiy’s goal from IP’s public policy attribute. In this goal, the supporting policy should be more normative, sustainable and comprehensive, also should be applicable to distinguish the type of IP rather than unifying application. What’s more, the policy’s supporting measures such as IP assessment, the IP trading market, IP financing’s program and IP financing mode need the policy to support.
