Public Participation In Local Government Legislation

The legislation is a vital problem related to the national economy and the people’s livelihood. It is not only directly related to the major interests of the broad masses of the people, but also concerned the long-term development of our country. Local government legislation is an important part of the legislative system of our country and has played an important role in the improvement of the construction of legal system of our country. With the further development of the socialist harmonious society, a robust legal system, the firmly establishment of the concept of law and continuously improvement of the awareness of civil rights, democracy and science concept has been widely accepted."Open the door to legislate", making the wider public to participate in the legislative process has become an irreversible historical trend in the construction of democracy and legal system. Through hearings and other various forms of participation ways in the legislative activities and the practice of law, the local legislation is ensured to be the legal, impartial, scientific and effective means to protect the fundamental rights of public participation and reflect the democratization in local government legislation.Government and academia put more emphasis on public participation in the legislation and the study of public participation in local legislation has a very important theoretical and practical significance. China has promulgated a series of laws and regulations such as the Legislation Law. The local governments throughout the nation also conform to the trend of social development, the practice of public participation in local legislation carried out a wide variety of public participation mechanisms and practice. Although in recent years in the public participation of legislation achieved significant results, but it is undeniable that there still exist some problems, such as the local government legislature dominant is too strong, the opaque in local government legislative process, the information is not public, the lack of institutional guarantee public participation, the lack of awareness in public participation. Therefore, it is necessary to re-examine, summarize and seriously thinking to further promotion and improve the public participation in local legislative system.In view of this, for the status quo of public participation in local legislation, the author has done something to think about the public participation in local legislation:Firstly, it is necessary to improve the relevant laws of public participation in local legislation to ensure the rights of public participation in the local government legislation. Secondly, it is necessary to improve the legislation procedures and enhance the legislative system of public participation. Thirdly, build the participatory civic culture and improve public participation level and ability of local legislation. Fourthly, it is necessary to promote the diversification and facilitation of public participation in local legislation. Fifthly, it is necessary to make the establishment of public participation the interests of the local legislative incentives and enhance public participation in the enthusiasm and initiative. The mechanism for public participation of our local legislation should be improved to enable the legislative democracy, and make the local legislation truly reflects the will of the people.
