Wireless Advertising is emerging forms of advertising, which gradually appeared inpeople’s view in recent years. Since the2008CCTV3.15Party exposed that Focus Mediasend out “Junk SMS “, people had been a negative view to the Wireless advertising. When2012CCTV3.15Party exposed the "Junk SMS" once again, the fragile nerves of people weresting again, now " Junk SMS" has become the representation of Wireless advertising.However, for such a new advertising dissemination way, we also ought to see its positiveside. Wireless advertising is not completely useless “rubbish ", when we need to understandsome information about products which they want to buy, when we want to know which shopis in the discount, we will think of wireless advertising. It can make us to remain within doorscase, to get more product information. Since China Wireless advertising industry is at thebeginning stage, tortious conduct of releasing wireless advertising can be seen everywhere,but legal regulations for tortious conduct of releasing wireless advertising are not perfect,which resulted in this kind of awkward situation.This article analyze the characteristics and reasons of tortious conduct of releasingwireless advertising, carry on research on the reason why tortious conduct of releasingwireless advertising is banned repeatedly again and again. In the principle of imputation andcompensation about tortious conduct of releasing wireless advertising, the author has done alot of research, learns from foreign advanced legislation experience, and puts forward somefeasible suggestions. To solve problem of tortious conduct of releasing wireless advertising,this has a certain reference value. It can make that wireless advertising provides better servethe people, make people’s life richer in culture, provide convenient to people shopping, makeChina wireless advertising----this emerging market----gradually grows on the orbit of therule of law.
