International Law Coping Mechanism To Transboundary River Pollution

The community of nations have paid more and more attention on thesignificance of environment protection. Environment and development arethe two major themes of human society. River, as one of the freshwaterresources, is related to the destiny of human beings. Now the amount oftransboundary rivers in all of the world has being more than250. Moreover,the transboundary river always tend to be a longer and huger flow river,which also has a vast watershed area. Therefore, the protection oftransboundary rivers becomes an important part of the protection of thefreshwater resources.International Law Coping Mechanism to Transboundary River Pollution isthe subject of this paper. I have focused on the definition oftransboundary river pollution on international law, and, the existingcoping mechanism to transboundary river pollution. On the aforementionedanalysis, I concluded the defects of the existing coping mechanism. Thepurpose of finding problems is solving problems. Although the draftingof specific legal provisions and the design of organizations ontransboundary river protection are now beyond my capacity, I tried to makesome macro and directivity suggestions. The paper consists of three parts.The first part is the definition of transboundary river pollution.Started with the literal meaning of "transboundary river "," pollution"，I make it clear that there are difference between transboundary river,international river, transboundary water, international watercourse,which are so similar that were blended over a long period. I have alsosummarized the characteristics of transboundary river pollution,classified the type of transboundary river pollution. The second part is the main body of this paper. Firstly I studied themain viewpoints in academia and major international legal documentsrelated to the transboundary river protection. On such basis, I summarizedthe existing coping mechanism to transboundary river pollution, includingsystems and organizations.The third part, via the above definitions and analysis of existingcoping mechanism, I summed up its shortcomings and deficiencies, and triedto find the improvement for these defects in macro.
