Research On The Secondary Victimization Of Criminal Victims And The Countermeasures

With the continuous development of society, the rule of law continues to besounded, the protection of the legitimate rights of the individual continue to be apriority, the concept that the legitimate rights of criminal victims should beguaranteed,which had been neglected in a longer period of time, gradually get therecognition and support of the international community. The whole society gettogether, from the legal, economic, medical, and other assistance available for victims,to help victims against the crime has become the consensus of many countries.As the bear side in the more serious crime, the criminal victims have to endurethe loss and suffering of the material and spiritual aspects of crime. Victimizationexperiences become the criminal victims’ psychological shadow, and has beenaccompanied with the victims within a period of time. Victims of criminal acts againstcrime, both physically and psychologically in a weak position, compared to the usualsituation, the protection of its own legitimate rights will exist a certain weaknesses. Inorder to be able to make their own legitimate rights which have been infringed to berecovered or get the reasonable compensation, the criminal victims need to face thecase investigation, prosecution and throughout the trial stage. In these processes, themisconduct in the criminal justice process and social life will cause the material termsor spirit damage again. Lead to the legitimate rights of criminal victims are not reasonable protection, which will bring the criminal victims and their families, andsociety as a whole have a negative impact.The thesis is divided into three chapters. The first chapter introduces specificpopulation referred for Criminal victims, and analysis of the concept of secondaryvictimization, characteristics and classification, identify the range and characteristicsof multiple secondary victimization. The second chapter analyze the reasons of thesecondary victims phenomenon. Proceed from outside of China’s criminal justicesystem, including law and law enforcement aspects,social life as well as the internalpsychological characteristics of victims, further clarify the reasons may causesecondary victim occurred. The third chapter introduces the countermeasures shouldbe taken in order to avoid the secondary victimization, and protect the legitimaterights of criminal victims. According to the reasons of secondary victimizationoccurred, make recommendations which are targeted, in order to protect the legitimaterights of criminal victims.Analyze the secondary victimization phenomena, to clear its causes andproposed countermeasures accordingly, let the victims who are suffering from thepain of crime be able to assist the criminal justice in the case investigation,prosecution and trial without scruple, let they and their families’ daily lives restore assoon as possible, let their psychological pressure be minimized, protect theirlegitimate rights, all these are the main purpose of this thesis.
