On School Bus Safety Legal System

In line with the <Regulations of Safety of School Bus>, a school bus is a type of bus specifically designed and manufactured for student transport:carrying children to and from school and school events, which complied with the Chinese school bus safety standards and run the fixed-line, In China,the history of development of school bus is really short. Until2010, various types of school bus accident one after another, school bus actually went into the field of view of the government and public.School bus safety legal system as the research object of this paper, and focus on the issue of "how to build the system of school bus safety laws to protect China’s school bus safety". The article mainly uses the case study method and specification analysis, looking for the true face behind the school bus safety incidents, and explains the right and wrong of the existing legal system of the school bus safety, then dig out measures to address the safety of China’s school bus from a legal point of view. In the first place, I completed the statistical analysis of the substantially manifestations of Chinese school bus accident; then, I carry out analysis of the specific case study, and find out there are four ostensible reasons in the school bus accident in China:first,the matter of school bus driver; second,vehicle performance problems; third, the matter of overloading; fourth, other reasons. Unveiled the mask, the underlying causes are:first, the lack of responsibility of government in the school bus safety management; second, public neglect of school bus safety issues; third, the imperfect system of school bus safety laws.<Regulations of Safety of School Bus> are the first specific regulations of China school bus safety, which uphold the overall idea and provides for the principle to solve the problem of school bus safety in China from a legal perspective. However, there are still a number of shortcomings in <Regulations of Safety of School Bus>:first, the legal concept of school bus is not clear; second, school bus access privileges suspected breach of the <Legislation Law> and the principle of legal hierarchy; third, part of the legal provisions setting exists omissions in <Regulations of Safety of School Bus>.Actually,"school bus" is not really troubled school bus safety, but school bus safety issues reflecting the imperfect legal system and the lack of scientific spirit of the law. Therefore, building a school bus safety legal system, it is necessary to improve school bus safety legal system, and also necessary to foster the scientific spirit of the law of the public.
