On Private Detective Industry:Its Regulation And Standardization

Private detective is a person who can be hired by individuals or groups to undertake investigatory law services. The profession was originated from the Western society in early1830s. After almost200years of development, private detective is playing a role in the protection of individual rights, social order, market economic order, litigation activities and many other areas. It is now a profession as respected as lawyers and doctors. Similarly, the private detective industry has been growing since early1990s in China. Due to the lack of legal provisions, the private detective has been in the grey zone. Therefore, we should conduct our study of the healthy development of private detective industry rationally. This paper will first introduce the history and development of private detective profession, address its present state in the West and China, in order to prove the existence of the private detective profession meet the demand of social and legal development. Secondly, it will compare and contrast the corresponding relationship between the profession with many other legal affairs from two different perspectives of both civil and criminal laws. Last but not least, the paper will discuss and design the practical system of how private detective industry could be professionalized so that it could play its role in the Modernization of China.
