The Study On "Governing By Rule Of Law"

On November8,2012, comrade hu made a report during the18th NationalCongress, in which he theorized that,"We should ensure that leading officials areguided by law in both thinking and action in their effort to deepen reform,promotedevelopment,solve problems and maintain stability."It is the first time that ‘Governingby Rule of Law’ is proposed. And then come the questions:what ’Governing by Rule ofLaw’ is,why it was proposed,what its meaning is,how to use it,and how it willfunction,etc. All of these questions should be deeply studied. Only based on scientificand complete theoretical system,can the governing by rule of law function better in thesocial affairs. Talking the above into consideration,and based on the reading of relatedmaterials for research, this paper studies on some essential issue about the governing byrule of law. Specially, all the research is combined with the current situation ofChina,which is the basic position of the article.The first part states the basic theories of the Governing by Rule of Law, includingthe conception,the connotation and the features.Before these presentation, the theoriesabout the Rule of Law are presented first.The second part of the article discusses the meaning of the Governing by Rule ofLaw, and the few most important meanings are involved.First, it is a inevitablerequirement and achievement of the process of building rule of law.Secondly, thegoverning by rule of law is the only road to the success of the political restructuring, theeconomic system reform, promoting development, resolving contradictions, andmaintaining stability.The third part discusses the application problems of the Governing by Rule ofLaw.The discussion begins with the connection between the Thinking by Rule of Lawand the Governing by Rule of Law, then goes deep into how to improve the ability ofusing it to govern a state,and ends with the discussion about the safeguards that makesthe Governing by Rule of Law be surely put into practice.
