The traditional relying on a single city and legal administrative adjustment method had not effectively solved the problem of regional air pollution. Therefore, we need to use the regional legal adjustment method in the regional problem of atmospheric pollution by administrative area units. Because the successful use of legal coordination mechanisms in regional seas, we should apply to regional legal adjustments in the air pollution. There mainly have three reasons:First, the natural eco-system air flow of factors makes all the administrative regions which is not only the output of the air pollution but also a receiver. Second, with the value of fairness and justice of the law, we should use regional legal adjustment method in the region to achieve a balance of interests between the multiple stakeholders. Third, regional content is easy to apply joint implementation of common measures for the prevention and control of air pollution. Finally local government environmental protection departments may use low-cost inputs to achieve the high efficiency of the Atmospheric Pollution Prevention. So we need to adopt regional legal adjustment method in the prevention and control of atmospheric pollution.In order to build air pollution coordinated regional legal mechanism, we first require a clear definition of the region. Zone has different classification type. In accordance with the different standard. Drawing on the zoning method in marine issues, China’s air pollution zone should be considering, the natural ecological factors, the economic and social factors. This is the only way to scientifically divide the area of prevention and control of air pollution in China. Therefore the local legislature can not developed jointly Unified regional rules or regulations for the control of air pollution in regional legislation. We should regulate similar content with the local regulations. In the joint conference on prevention and control of atmospheric pollution, behalf of the subject achieve the regional cooperation agreement for the control of air pollution. Based on it, the local legislative respectively enact the draft law. After the draft law reach an agreement again, the legislative separate vote to pass and release. Finally we establish regional coordination of legal mechanism for the control of air pollution. |
