This article assessed the problem on financial innovation of commercial banks in the view of the cross-discipline subject of the Finance and the Law. We adopted the comparative analysis, qualitative analysis and quantitative analysis to explore the related issue based on the commercial banks in China and the US.Firstly, the article compared and analyzed the financial innovation environment of the commercial banks in China and the US, then we compared the difference in the respects of the financial regulatory environment and the patent legal environment. Secondly,we investigated the knowledge spillover effect of the financial innovation from the commercial banks of China and the US in the short and long term to analyze it in the theory.Considering it, we analyzed the practical cases based on the data of finance patent from the commercial banks to accord with the theoretical analysis of the above.By analysis of the theory and the cases, we came to the following conclusions. First, the imperfection of the finance innovation environment leads to the insufficient finance innovation motivation of the commercial bank in our country. Second, the unreasonable financial regulatory environment restricted the development of the finance innovation of our commercial bank. Third, the unsound Business Method Patent system limited the development of the finance innovation of our commercial bank. Fourth, there existed knowledge spillover effect in the financial innovation of the commercial banks in China and the US. Lastly, based on all the conclusions, we put forward some suggestion in the respects of the external environment and these commercial banks themselves.
