With the amplification of China’s foreign trade scale,exporters in China are paying much more attention to the transfering of dilivery risk,which plays a very important role in dividing the exporter’s rights and obligations.So in order to meet the need of the exporter’s risk prevention,we should summarize the rules of risk transfer in the international trade,help the exporter confirm the transfering boundary and provide some measures for them to prevent the delivery risk.Analysis,induction and case analysis are employed in this paper.We analyze the goods delivery time,delivery place and delivery way under different trade terms,and the documents delivery time and delivery mode under different international settlement. We compare the three basic rules about the transfering of delivery risk,and induce the international rules in this aspect while explaining cases.In the end,we induce some ways to confirm the transfering boundary.Besides, we analyze how to confirm the transfering boundary of the delivery risk,and how to prevent it from the point of the exporter instead of the law or the insurance company.There are five sections in this paper.The first section summarizes the studying on the risk transfer home and abroad.The second section analyzes the three basic rules relating to the transfering of delivery risk in the international trade,and induces the international rules in this aspect as well as introducing some cases. The third section offers the export ways to confirm the transfering boundary of the delivery risk from the point of goods delivery, documents delivery and transfering the ownership.The forth section provides suggestions for the exporter to prevent the dilivery risk so as to help the exporters to benefit from the foreign trade. The last section stresses the importance for exporters to strengthen the risk awareness.
