Land is an essential element of economic and social development. The proper use and effective protection of land is directly linked to the long-term interest and development of the Chinese nation. But in recent years, the local government’s illegal occupation and abuse of land has led to a drastic reduction in cultivated land in China. In order to strengthen the country’s macro control of land, to enhance the local government’s responsibilities to protect land resources, and to implement the most stringent farmland protection system, on May2nd,2008, the Ministry of Supervision, the Ministry of Human Resources and Social Security, and the Ministry of Land and Resources issued Administration Punishment on Behaviors Violating Land Management Regulations, emphasizing that Chief Executive Accountability System should be implemented to deal with illegal behaviors. Local governments in such cities as Chongqing and Wuhan issued Chief Executive Accountability System on Violating Land Management Regulations.It is of great significance to establish and improve the land administration system of accountability. Firstly, supervision of government’s actions on land can be enhanced, government’s behaviors can be regulated, and land use efficiency can be further improved. Secondly, it can urge governments at all levels to implement land management responsibilities effectively, to implement the most stringent farmland protection system, thus the country’s food security can be ensured. Thirdly, by regulating government’s behaviors, various social conflicts caused by land can be alleviated, which contributes to promoting a harmonious society.Taking land administration accountability as the research object and drawing on the experience in the administration accountability system from the West, this paper summarizes the present status of China’s land administration accountability system. Then this paper focuses on and analyses the documents, regulations and policies on land administration accountability issued by the central as well as local governments. By confirming the functions as well as pointing out the shortcomings of these documents, regulations and policies, this thesis puts forward countermeasures for improving China’s land administration accountability system, so as to enhance supervision on government’s land administration, to regulate government’s behaviors of land administration, and to ensure the permanent use of land resources and the sustainable development of society and economy. In addition, based on defining land administration accountability system and having an overview on the theories, this paper looks back on the background, exploration and shortcomings of China’s land administration accountability system, and at last proposes the countermeasures for improving China’s land administration accountability system. Firstly, organize well the land management system and improve the efficiency of accountability. Secondly, compile Law on Land Administration Accountability for China. Thirdly, improve and strengthen third party accountability system. The third party includes the National People’s Congress, judicial authorities, news media, and citizens and so on. Fourthly, cultural development in China’s land administration accountability should also be improved. |
