Study On The Failure Of Food Recall System

Abstract： In the wake of a spate of scandals about food safety, closerexamination on the failure of our food recall system should be made.Traditionally, the failure of food recall system should be seem as the gistfrom the angle of legal doctrine. In terms of normative study and relying onthe available literatures, two points of view that conclude high cost/risk onbusiness and political structure should be confirmed, the views of legalhierarchy, tough penalty on business and lack of fund should be eliminated,and two points should be put forward corresponding suggestions. Even if alarge-scale endeavors that have been followed the traditional approach,infinite sequence on the pattern of "causes of failure——effective measures"seemed to be hardly avoided. Concerning to this conundrum, the traditionallegal doctrine should be transformed to the sociology of law. Depending onempirical study, the theory of supply and demand and the criteria ofstakeholders, intentional function and instrumental function of food recallsystem should be put forwarded, and the state how formal system andinformal institutes that playing out in realistic operation of food recall shouldbe described clearly.
