The Study On The Questions To Provide Patent Service Of The Government In China

Patent is an important part of intellectual property rights. From the international perspective, patent is a strategic resource for all kinds of enterprises to promote core competition ability, build technical camp and participate in international competition. From the domestic level, patent is a strong support for China to promote innovation of country technology, transform the mode of economic development, and promote the construction of innovative country and economic sustainable development. Since China’s accession to WTO, the importance of patents is further reflected. At present, our government has put patents intellectual property to the height of national strategy. However, China’s patent system started late when compared with western developed countries. The government attaches great importance to the patent approval of contempt and pay little attention to patent application, and also a serious lack of corresponding service. Besides, the incompletion of China’s market economic system and social service organization, and the lack of initiative of market main body to use patent, caused relative a high output of patent but low application situation. As a result, our patent system failed to play an important role in promoting economic and social development. At present, to achieve the function of patent system and patent strategy, our government not only needs to improve services in the patent examination, protection and management, but also to guide the social intermediary patent service consciousness and ability, to improve and perfect the patent intermediary services. These can provide quality services and promote creation and application of patent for the market main body.In this paper, problems as to patent services provided by China’s government were studied. Firstly, research background and research significance, comments on the present research situation home and abroad, and research contents and methods were introduced. Secondly, the connotation and character of patent, patent service concept and classification were interpreted, the patent services based theory were summarized and analyzed, and the necessity of the government for providing services were discussed. Then, status of Chinese government in providing patent services based on the combination of actual data and related information were studied, initial achievements of the government in providing patent services were affirmed, and problems such as incompletion of policies in providing services and low level of transformation and utilization and causes were deeply analyzed. Lastly, the mode of advanced foreign governments in providing patent service was summed up. Finally, based on theoretical analysis and practice experience, countermeasures and suggestions on improving our country government in providing patent services were put forward. Through the study in this aspect, it helps to promote the theoretical research on patent service issues more in-depth study, and also provides some reference on improving the patent services of our government.
