Cunently, increasing industrial pollutionin mral areas resulted from the growth of in-dustry presents a grave threat to rural envimnment,agricultural resources,and the sustaina-ble,healthy and stable development of the rural areas.The rural environment problem is a big issue.This paper tries to choose one of the aspects of rural industrial pollution:rural industrial pollution to explain and understand rural environmental problems,combining legal means to adjust and control the effective of rural industrial pollution.The article analyses the legal regulation current situation of the rural industrial pollution problems.then investigate the cause of the rural environmen-tal problems.in order to do somebeneficial discussions for solving rural environmentai pr-oblems and legal protection measures for the farmers’environmental rights.The article is divided into the following six parts:The first part introduces the research significance,background,the method,the struc-ture arrangement. Challenges in the research situation as well as of this writing process, and innovation are briefly introduced.The second part sorts to the the oretical basis of the prevention of industrial pollution in rural areas of legal issues. Law aspects of the use of farmers’environmental rights the-ory, environmental justice theory and the right to subsistence and development theory; the economics of the use of sustainable development theory, the theory of economic external-ities and government failure theory. Rural industrial pollution control issues based on the dual perspective of law and economics, a more systematic analysis to provide a theoretic-al basis for the study of rural environmental pollution control laws and countermeasures.The third part introduces the sources of the pollution from rural industrial,urban poll-ution to the transfer of rural and township enterprises pollution and other pollution status on rural industrial pollution, endangering the health of the farmers, the substantive rights of property security, rural social stability and farmers’ environment procedural envirome-ntal rights of information, participation, and claim damages. Then reveals the backwardn-ess of China’s rural environmental protection legislation, the existing problems of the leg-al system in the rural industrial pollution prevention and control process of the governme- ntal environmental responsibility, absence and lack of corporate environmental responsib-ility.The fourth part is to study the legal system of the rural industrial pollution preventio-n prevention and control of relevant countries and regions. Through the investigation of t-he status of the rural industrial pollution prevention and control such as the Sweden,the United States, Japan;and through deeply analysis of the rural industrial polluti-on prevention and control in different countries, provide some experience for the rural in-dustrial pollution prevention and control in our country. And the experiences are followi-ng: Comprehensive utilization of economic, administrative and legal measures to combat environmental pollution in rural areas; improve the rural environment management syste-ment system, the establishment of a sound rural environmental protection, public participation system; to strengthen the environmental education of the public.The fifth part presents the legal system to improve the rural industrial pollution con-tro in our country.first,we Should determine the inter-generational equity and intra-gen-erational equity, security and efficiency of unity, environmental, economic and social co-ordination of the development of ideas; second,we shoud proposed to improve the gover-nment’s environmental protection laws and responsibilities, improve the system of gover-nment responsibility in the legal protection of rural environment, and enhance the rural environment law enforcement, establish a strict government environmental accountability system, finally,mprove the rural environment of the judicial system, strengthening the role of rural industrial pollution prevention and control of economic government respon sibili-ty system in terms of perfecting the legal protection of rural environment; the from the township of corporate social responsibility, corporate environmental information disclosure system, the establishment of the ecological environment compensation mechanism and other aspects to improve corporate environmental responsibility system in rural industrial pollution control.The sixth part is the conclusion language outlook.
