All these disasters tested the Emergency response system of the society. It is a problem for all the society to consider how to retrieve more life and property in the Golden72hours. To be one of the most important roles of the market economy, what responsibility enterprises should take and how they take are the objects of this thesis. According to the new thesis of the public emergency, the enterprises use the limited social resources to get profit, and then the enterprises must take the responsibility to make the society return to normal condition as a corporate citizenship. This is the basic thesis for the CSR in public emergency and it is the possible to make the CSR institutionalize. At the same time, the frame of the positive law has improve the basic of institutionalize.Based on the existing enterprise society responsibility of the legal basis, this thesis argument the enterprises’responsibility in public emergency, with both legal support and the reality of new need fusion.The CSR in public emergency has double features, moral obligation and legal responsibility. Then the government should make two aspects to make it in law. To the legal responsibility, the government should defined clearly in the law on response to emergencies, and enhance the people’s rights in law of state restitution. Improve the law through from both obligations and rights. To the moral obligation, the government may urge the enterprises to establish emergency response system through correct and active guide. And then establish the society emergency relief system.
