With the accelerating of industrialization, urbanization, marketization, informatization and globalization, a large number of rural surplus labors flow into cities, which lead to the generation of the special group and the phenomenon of large-scale cross-regional flowing of migrant-workers. Now they have been important productive force in the urban construction. However, as migrant workers approaching the modern career system, the missing of migrant-workers’industrial injury interests have been normal for various reasons. Firstly, they are mainly occupied in the business characterized by highly dangerous, polluted and heavy workload. Secondly, there aren’t relevant to social security system and this group isn’t capable of withstanding risks. Now more and more attention is paid to the problems of the injury suffered on the job for the reason of the increasing of industrial accidents and the growing contradictions between the two sides of labor and capital. Although a series of policies to protect the migrant-workers’ rights has been introduced, the rights of injured workers are still not adequately protected due to various combinations, so as to inefficiency at a practical level. This phenomenon is violated to social justice and is harmful to the building of harmonious society. In the presence of disputed fact that migrant workers fail to be secured by industrial injury security system, it’s a realistic project for the government, enterprises and migrant workers, that how to avoid risks and protect the rights of migrant workers by taking appropriate steps.The research of migrant workers industrial injury security rights could meet the needs of the social security system construction overall urban-rural development on both theory and practice. It’s a new conjunction point, with supplying a lot of room for exploring and feasibility study, which also would be an important orientation and new growth point. First of all, this research discuss the three sides game structure among the government, enterprises and migrant workers under the real institutional environment at the theoretical perspective of Game Theory, and explore the reason for the missing of industrial injury security rights on migrant workers from the aspect of the institutional and strategic factors. Finally, the research would be a useful reference sample to build harmonious labor relationship. It has explored the possibility of the transforming from the conflicting to cooperation between labors and enterprises, and study the way to protecting the rights of migrant workers from the perspective of social stability and social harmony, with respecting the labor rights of migrant workers.Migrant-workers, enterprise and government are all economic rational behaviors. It is by studies that all of them will stick to self-benefit strategies under certain circumstances or restrictions, according to their information. This is a big reason to the situation that migrant workers are pushed into the absolutely inferiority in the trilateral game. Especially when currently the work injury insurance system is not that mature, government and enterprise are more easily to gain more information. The empirical studies on rights in migrant-workers industrial injury protection will help summarize local experience in richer parts and scientifically predict the future. By exploring key points and existing challenges in migrant-workers industrial injury protection and studying how to develop and promote conditions, systems and path in the protection, a harmony labor relationship may be well constructed through the process from confliction to cooperation. Finally, it will provide theoretical preparation and reference samples to better construct the social security policy in the process of urban-rural integration.
