Since1987Taiwan has allowed people to visit relatives who live in the Mainland, the communication and cooperation between Taiwan and Mainland in the field of economic, cultural and other various fields have increased. In1985, higher education in Mainland was available to Taiwan students. At the same time, Taiwan allowed Mainland students taking short-term exchange studying in Taiwan. In recent years, as the quality of Chinese education gradually being recognized, additionally the tendencies of friendly relations policy of KMT, caused Three Laws about Mainland Students Amendment was eventually passed. These bills officially allow Mainland students to go to Taiwan colleges, and Taiwan also preliminarily admits the diplomas of41Mainland colleges, which deepen the communication and resource sharing between Mainland and Taiwan colleges and universities. Thus, the in-depth study of the Mainland students’policy’s making process and influence factors can provide some theoretical basis and reference for the communication and development of cultural and educational between Mainland and Taiwan. It also can provide some references for the construction of Mainland education legal system.This study mainly discusses the legalization of Mainland students’policy and its education legal system from the following five aspects. The first aspect involves some concepts definition of Taiwan’s policies about Mainland students, and also includes the methods and significant of this study. The second part focuses on the back ground and contents of legalization of Taiwan’s policies about Mainland students, discusses the legalization’s six procedures, and deeply analyzes the contents of these policies. Based on the above two parts, the third part is about the legal system and hierarchy of Taiwan education. It shows the level divisions of education policies and the relationships of each level. In this part, it also includes the analyses about the legalization processes and affecting factors in different stages. The forth part mainly analyze problems of these policies and its tendency. Finally, according to the reflection of the policy legalization process, this thesis sums up some suggestions for the improvement of the legal system of Mainland education. It also hopes to provide some theoretical basis for the cultural development of both straits.This article adopts the methods of literature analysis and text analysis to collect a large number of education regulations, related laws, books, journals, newspapers and network resources about Mainland and Taiwan, and analyzes and synthesizes the text content of higher education laws and regulations. Analysis of Mainland students’ policy and processes and factors, and explore the structure of their education legal system. According to the analysis of Taiwan’s legal system, it is a good way to improve the Mainland educational legal system by absorbing Taiwan’s advantages.
