Along with the development of our country’s economy and society and the enhancement of people’s democracy and rule of law consciousness, to the voice of the people democracy is also higher and higher, the state promotes economic and political system reform gradually, conform with the socialist democracy, the rule of law of social development trend, and strive to achieve maximum range of fairness, justice, protect the vital interests of the people. Education is an important way to realize social fairness, justice, most young people change their destiny by learning knowledge, improving ability, so, realizing the education field internal fairness, justice, and realizing the education balanced development are especially important and urgent. For all these reasons, at present, all types and at all levels of the school education administrative phenomenon in our country is still obviously, which hindered the realization of school running autonomy.Accordingly, management professional, administrative, professor research will become the guarantee of the autonomy and promote education school balanced development, realize the starting point of the inevitable choice of equal opportunity.This paper is based on Chinese economic and social development of the reality of education fields faced status, and primary school principals and employment system into the reform, this paper discusses the existing primary and middle school "the President responsibility system" the pros and cons of the management system and how to further reform the existing system, the selection of Sichuan province Nanjiang county school principal employment system reform as a typical case study, strive to on theory and practice for fairness, justice, and choose selection school principal, improve the principal management level and performance to explore more and puts forward some constructive method.This study adopted to give priority to qualitative method combining qualitative and quantitative methods of research method, the concrete used the methods of investigation, and literature, comparative law. First of all, the author investigated Nanjiang county school principal employment system reform background and conditions, the author went there two times and did the survey of some staffs in Nanjiang Bureau of education, middle and primary school principals and teachers, based on this study, the author divided it into four aspects:The first is the legal background of administration according to law and administering education according to law.The second is the realistic background of the requirement of Nanjiang county’s social development and the present situation of education development and career development. The third is idea background of Nanjiang county, the county government scientific leadership, reform and innovation, people foremost, moderate decentralization of governing. The last one is the background of value pursuit of local government education administrative department leaders’personal values and ideals. The author introduced Sichuan province Nanjiang county school principal employment system reform of the specific content and implementation in detail; summarized the results of the employment system reformation during the recent five years. Then, the author analyzed school principal employment system reform practice in Nanjiang county Sichuan province theoretically, mainly from four aspects of analysis:the incentive theory in management, target management theory, the organization operation theory and the division of labor theory, analysis the theory which contained in Nanjiang county school principal employment system reform, demonstrates the theoretical basis of the reform and feasibility. Then, compared reform before and after Nanjiang county school principal performance, from the main body, the achievement of performance way, performance goals three dimensions, mainly the principal achievements and some existed problems, whether it has reference value or the promotion. Finally, on how to improve the performance of the school principal, from Sichuan province Nanjiang county school principal employment system reform of inspiration, puts forward four thoughts and Suggestions:the first is the election of advanced principal fairly and democratically, the second is abide by the laws, administering education according to law, and improve the implementation, the third is to establish incentive mechanism, the innovation mechanism of fair competition, cohesive and strength, and the fourth is scientific decision-making, democratic consultation, mutual learning, harmonious interaction.Taking a county in western China’s employment system reform of middle and primary school principal research point, comes from practice regression practice, hope that more scholars in Education legal field pay more attention to Education democratization, school management specialization by writing this paper, to promote education fairness, education equilibrium, the progressive realization of school-running autonomy.
