Education is the cornerstone of national rejuvenation and social progress. In2013, national ordinary university graduate scale will reach6.99million people, more than0.19million in2012, which leads to a more complex situation and a sever task for the graduates employment. Recently, the contradiction in the China’s employment structure is obvious and the college student labor force is beyond the requirements. In order to stand out from the fierce social competition and the numerous applicants, more and more college students try to accumulate their practical experience and employability form the internship. As the internships increasingly being taken seriously, the "internship problem" is highlighted and the situations that the damage of the college student’s rights and interests during the process of internship become common. And according to the current education in China and the provisions of the labor law, there is no corresponding rights and interests protection and judicial relief to such kind of phenomenon, which this article discuss the problems about university teaching internship agreement centrally reflects the dilemma. Teaching internship agreement is an agreement which clear the school’s, the internship unit’s and the student’s rights and obligations. As the internship agreement involving different parties of rights and obligations subject, the content of the internship agreement is relatively complex and the internship agreement also plays an important role in practice. However our country did not establish an appropriate internship agreement system. Furthermore, with the internship students’ special worker identity, there are lots of problems about the signing and implementing of the college student’s internship agreement. This article embarks from the teaching practice, defines the nature of the labor relationship during the college students’teaching practice from the legal level, clear the basic content of college teaching internship agreement, and through the analysis of existing problems about the signing and implementing of the college student’s internship agreement and drawing lessons from foreign experience, so as to perfect the system of college teaching internship agreement in our country. This article altogether is divided into four chapters:Chapter One introduces the basic problems related to the college students’teaching internship agreement, including the definition of practice teaching for college students, legal relation of college students in teaching practice, the concept and basic content of the college students’teaching internship agreement.Chapter Two is mainly talk about the current situation of the college students’ teaching internship agreement law of our country, including the review of the law of college students’ teaching practice, the analysis of the defects of the protocol which exist in China’s college students’teaching internship agreement.Chapter Three is mainly about the reflection on existing problems of China’s college students’teaching practice agreement. The problems about the signing and implementing of the college student’s internship agreement are presented respectively. Also the issue of the difficulties in signing and implementing of the college students’ teaching practice, the lack of unified regulations in the internship agreement, and the difficulties of reflecting the effect of the internship, identifying the subject of the injury suffered on the job during the process of internship and remedying the violation have been analyzed under the current legal framework.Chapter Four is mainly about through drawing lessons from the foreign experience, consummate China’s system of college students’ teaching practice agreement. By the introduction of Britain, the United States, France, Germany and other countries’college students’ internship system, especially the content of the internship agreement, as well as the experience for reference, construction measures which are beneficial to the student internship agreement system are put forward aiming at the problems existing in the college teaching internship agreement. First of all, the government should strengthen supervision and management and establish the student internship agreement system the in the form of laws or regulations; Second, enterprises should strengthen the construction of the trainee system to fulfill their social responsibility in the national education; Third, universities should set up specialized agencies and construct internship information platform to strengthen the management of college students’ internship agreement; Finally, establish a special liability insurance system for college students agreement system as a strong support.
