With the accelerated process of industrialization and urbanization, the need of urban land is becoming tense. The land acquisition is being gradually extended to rural areas, so the expropriation of rural land gradually becomes an important land expropriation object. Because the lands are the main means of production of the peasants, and it related to the basic survival of peasants, the country’s food security, harmony and stability of the whole society. Thus the expropriation of the rural land should have strict procedures and regulations to protect the land expropriation system of strict and standardized. However, the degree of democratic participation in China’s land expropriation process is relatively low. Lack of participation of peasants is from the making of the land expropriation decision to compensation for expropriation program development as well as the distribution of the compensation program. Peasants’ weak awareness of the rights e and the lack of rights defending capacity made their land rights easily been deprived. In order to achieve standardization of rural land expropriation, and to ensure that the rights of peasants in land acquisition inviolable, the land system of need to be reform. So the law needs to give peasants the land expropriation law relationship of the main qualifications, enhance the participation of peasants in land acquisition, and give the peasants the substantive rights and procedural rights and remedies of the rights of peasants in land acquisition.
