On The Construction Of China’s Participation In The Land Expropriation System

With the advancement of urbanization, the reformation of the system of land expropriation has become a hot problem of social concern. Setting out from the state of our country, the article tries to comb the development of the expropriation system, examine its shortcomings, discuss the deep-seated reasons of the defects formation by drawing lessons from the overseas successful experience on the basis of defining the land expropriation. The article tries to improve the land expropriation legislation of china by renewing ideas and construction of system. I expect this article could do a little help to the reformation. Participated land expropriation system refers to the expropriation rights as the standard, which fully reflected the requirements imposed by the main body status, to ensure their equal participation in consultation and has the right to know in the procedure of land expropriation. In our law, collective land expropriation procedures is coarser, not science, impartiality and fair show sex was not enough. The current land expropriation system in China provides only limited participation rights. Only to be a person to enter in the process of land expropriation, can be imposed to protect the people’s legitimate rights and interests, in order to reduce conflicts in the process of land expropriation, in order to balance the public power and private rights in land expropriation.This paper is divided into three parts. The first chapter explains the concept of the land expropriation system, on the current land expropriation system of the pros and cons. The second chapter analyzes the legal basis of public participation in land expropriation. Next to the overseas land expropriation system of public participation was investigated in order to get out of significance. Finally, analyses the present situation and problems of our participation in land expropriation. The third chapter describes the overall framework established in land expropriation system in our country, then through the concrete system design and analysis of how to build the participation of land expropriation system in china.
