Research On The Commercial Bank’s Environmental Responsibility Legal System

Nearly30years Chinese economic development has made the excellent results,according to the national bureau of statistical bulletin, the gross domestic product is364.52billion in1978,by the end of2012that has reached51.9322trillion, increasedby one hundred and eighty times. At the same time, growing environmental problemsdeeply affect the quality of economic operation of the society and sustainabledevelopment ability in the future. Transformation of the pattern of economicdevelopment, exploration on new path to environmental protection, promotion inenvironmental protection and economic development coordination fusion, become themost important task in front of us. The current folk environmental protection andcorporate social responsibility movement is booming, and causes the social from allwalks of life for the profound thinking of environmental protection and corporatesocial responsibility. Environmental social responsibility is an important content ofcorporate social responsibility, enterprises should fulfill the social responsibility to theenvironment, and environmental social responsibility not only relates to the socialeconomy health movement and the social sustainable development, but also relates tothe survival and development of enterprise itself. Commercial banks as very specialfinancial enterprise, allocate capital holding power, the transformation of economicdevelopment patterns are important, should fulfill more than the ordinary enterprisesenvironmental social responsibility. In the background of economic globalization andinternational financial market turmoil, the commercial banks pay more and moreattention to social responsibility practice environment, gradually from the individualconsciously perform to the whole industry standardization, institutionalization, andgradually expand the financial sector to bear the social responsibility. Environmentalsocial responsibility of Chinese commercial banks is still in its infancy, especially theenvironmental social responsibility consciousness is weak, the legal norms and thelack of relevant system design has a very large and empty. So this paper based on thesocial environment in our country, by investigating the domestic and foreign advancedtheory research, the connotation of the commercial Banks to explore environmentalsocial responsibility for the premise, the analysis commercial bank environment socialresponsibility theory basis and reality basis, Analysis the status quo of commercialBanks to practice environmental responsibility and the reasons for the system level, tofill the blank of the related legislation as the backing, try other country legislation, tobuild our country commercial bank social responsibility specific system environment,to achieve the environmental social responsibility legal system of commercial bank.This article includes introduction, text and epilogue three parts. The text is divided into five chapters. The first chapter mainly concept basic theory part, this paperintroduces environmental social responsibility of the production and the environmentof commercial bank, defines the concept of social responsibility to clarify keyconcepts, as hereinafter described elsewhere. In the second chapter mainly introducesthe environmental social responsibility of the relevant theoretical basis and realitybasis, as a deep understanding of commercial bank, the necessity and significance tosocial responsibility to provide adequate instructions. The third chapter focus on thereality of social responsibility of commercial banks practicing environment, aiming atthe deficiencies in performance at the system level to do some kind of root causeanalysis, related system and draw lessons from outside to make comparison forreference. The fourth chapter the value pursuit of environmental social responsibilitylegal system of commercial banks in detail analysis, this paper expounds the methodand order, law and the legal value pursuit of justice and efficiency. Finally the fifthchapter puts forward commercial bank realization ways of environmental socialresponsibility legal system problems, mainly in the aspect of macroscopic legislationfirst fill the blank of the relevant laws and build concrete legal system on this basis,provides the legal basis for the commercial banks to practice environmental socialresponsibility.
