As the misleading notion of "stealing books is not theft" is still rooted in the minds of the general public, works have been uploaded to the internet in violation of the legal rights of the copyright owners by some people, with or without the purpose of pursuing private interests. In recent years, the infringement of rights caused by Internet upload has been strongly condemned as an attack on the protection of copyrights, and has stirred up bitter hatred of copyright owners and those respecting intellectual property rights. Therefore, it is necessary and urgent to govern internet upload. Given the above circumstances, this paper has conducted a research on the copyright laws and regulation on Internet upload.In this paper, the principle of the balance interests as the principles of the regulatory of upload behavior on the internet, as the regulation of the upload behavior of the idea, based on this, this paper first analyzes the existing pattern of interests based on the upload behavior in the environment of digital technology:Compared with analog technology, digital technology environment based on network upload behavior there is a new pattern of interests--the copyright owner, internet service providers and the public among the three interests conflict with each other, and the ideal state of the principle of balance of interests under the environment of digital technology is the copyright owner, the Internet service provider, the public three interests balance to determine the relative to their respective interests, borders, does not extend to any of them. If any party’s interests more territory, run the interests of other parties, will cause the imbalance of interests among the three. In the system of the regulation of network upload behavior existing, the Internet service provider is too loose, resulting in the interests of the three party interest imbalance, for the direct beneficiaries of the network service provider upload behavior, and the network service providers benefit but to upload behavior lax these two aspects into consideration, this paper believes that in the construction of regulation system should strengthen the regulation of the network service provider, to regulation of the network service provider as the Center reconstruction upload behavior regulation system. The regulation of network service providers as the center to reconstruct the network upload behavior regulation system, first of all to the regulation of the network service provider, in particular should strengthen from the Internet service provider for the copyright consciousness, strengthen the administrative supervision and build new business mode based on internet service providers to these three aspects; then the system to replace the responsibility of internet service providers add into the network upload behavior of the existing works right law system. Urge internet service providers to upload the subjective attitude of behavior to have a change to the network, and to carry out the strict control of the network upload behavior, so as to achieve the purpose of regulation upload behavior.
