Copyright Protection In The Network Environment Restrictions

With the rapid development of the internet technology and the worldwide population of Internet, the protection of copyright is under severe impact and challenges. Countries and international organizations issued relevant provisions to protect copyright of Internet, and to protect the legal interests of copyright holder under Internet. The meanwhile, it broke the delicate balance between the private right of copyright holder and public interests. This results the conflicts and contradictions among every interest, especially the conflicts of interests between copyright holder and public.How to balance the conflict is the problem which should be solved now. Copyright law protects human's wisdom, and copyright holders'exclusive right to their works. But this protection is not absolute and unlimited. For wisdom and knowledge need to use and accumulation, inheritance and development, this means it needs to communication to make the public to use, and to increase social wealth. In the other side the copyright restrictions should also be limited. If we blindly emphasis the public interest, it will undermine the copyright holders'creation passion. This requires a certain legal system to balance the interests. This article will describe the balance between protection and restriction of copyright under Internet by the theory of the interest balance. The first chapter introduces the theory of the interest balance, and it is important to use the theory to balance the copyright holders'private right and the public interest under the copyright protection. With the advancement of technology, copyright protection gradually extended to Internet. The second chapter mainly elaborates the copyright protection under Internet by International Organizations, developed countries and our country. And it also research whether it still needs the theory of the interest balance under Internet. It is necessary to construct the special system to protect and restrict copyright with the theory of the interest balance under Internet. The third chapter focuses on the special system of the copyright protection and restriction under Internet. And I will put forward some proposals through exploring and analyze the special system.
