The Research On The Problem Of Water Environment Protection From The Perspective Of Administrative Law

At present, the water environment protection is paid more and more attention in China, scholars discussed on the problem of water environment from many aspects. In this paper, the author selects the view of administrative law, focuses on the analysis of the water environment protection legislation in theory and Practice, to the responsibility of the government, finally trying to solve these problems, to achieve the purpose of protection of water environment. This paper is divided into four parts, the main contents are as follows:The first part describes the basic problem in water environmental protection from the view of administrative law. Firstly, defines the concept of water environmental protection system, about water body, water resources, water pollution, water ecology, water safety and water environment, and clear up the connection and difference among them, then, summarizes the connotation of the water environmental protection. Secondly, clear the two dimensions to solve the problem of water environment protection in the perspective of administrative law, namely water environment protection legislation and practice of water environmental protection.In the second part, this paper is to protect water environment from legislation. Firstly, reviews the status of legislation on protection of the water environment in the United States, Germany, Japan, and then summarizes the water environment legislation present situation and the question in China. Secondly, it puts the "Water environmental protection regulations of Hefei" for an example, makes an empirical study of the water environment protection legislation.The third part describes the government responsibility in water environmental protection from the analysis of water environmental protection practice. Firstly, define the responsibility of government in the protection of the water environment, secondly, sums up the responsibility of the government to protect the water environment in the form of manifestation, including water resources development and utilization, water pollution control, water ecological safety aspects of these three government responsibility concrete, finally, analyzes the problems of the government responsibility in the field of water environmental protection.The fourth part puts forward the solutions for water environment protection legislation. To be improved from the water environmental protection legislation and governmental responsibility for protection of the water environment, improve the water environment protection legislation including raising the water level of local legislation for environmental protection and establish and improve the water environment quality of legislation and evaluation mechanisms, improve the water environment protection Government Accountability includes building water environmental protection legislation, government accountability mechanisms, including clear accountability the main target of accountability, accountability conditions, using the economic measure, from introduction of public participation to play the role of non-governmental organizations, establishing civil environmental rights and the remedy system.
