| The main driving force of the development and progress in the world today is knowledge and technology, economic development dominated mainly by the new scientific and technological achievements, science and technology play an increasingly important role in all aspects of our lives, intellectual property rights as a kind of intangible property has aroused more attention. Our government emphasized and dominant innovative country strategy, strengthen the protection of intellectual property and encourage independent research and development, support innovative f technology, more and more companies began to pay attention to the protection of intellectual property and economic benefits. Patent right of pledge financing has become more popular in research projects of recent years.At present, financing difficulties of the small and medium enterprises is restricting the development of small and medium enterprises. Now, however, a lot of science and technology of small and medium enterprises has become a force to be reckoned in China’s economic and technological development. These companies do not have too much mortgaged property; the most important is the patent, how to solve the small and medium enterprises patent pledge financing problem has become more urgent. The perfection of the patent pledge financing system for intellectual property rights and social and economic development have a significant role in promoting.This article consists of six parts, the first part:the introduction introduces the research background and significance, literature review, research methods and main content, innovation, and inadequate of patent pledge financing; the second part:the basic theory of the patent pledge financing expounded the basic concepts and features, patent pledge nature, and the difference with other pledge financing; the third part is the analysis of the current the patent pledge financial problems, legal issues, patent value assessment and risk; the fourth part is the analyze of some developed countries patent pledge financing system; the fifth part is how to build our country’s patent pledge financing system; at last, the sixth part’s the conclusion part, the summary of the full text. This paper combines domestic and foreign legal requirements and practice, and make use of literature, comparative analysis and empirical analysis, studies our country’s patent right of pledge financing problems and solutions in legislation and related mechanisms, put forward some suggestions to improve relevant laws and the establishment of the mechanism more conducive to the development of the patent right of pledge financing, hope to provide some help for the improvement of the system and small and medium enterprises financing. |
